Are your company rates too high?

It's a question you'll find difficult to answer and no wonder. Rating law is constantly changing and revaluations can be a complicated affair.

Since the 1990 Revaluation and subsequent ones in 1995 and 2000, including the current 2005 Revaluation, we have successfully handled over 1,600 appeals on commercial properties throughout the UK.

We have helped to significantly reduce occupier's rating assessments and assist to establish refunds and statutory interest on any over payment of rates.

From 1 April 2010, all non-domestic subjects will be reassessed for rates purposes. Each new Rateable Value will form the basis of a ratepayer's liability over the next five years. The Rateable Value is a hypothetical rental value, at a point in time, based on certain assumptions. For the 2010 Revaluation, values are based on rents and costs prevailing as at 1 April 2008.

Arguably, the 2010 Revaluation may be the most contentious to date, since the effect of the "credit crunch" on the property market has had a distorting effect on rental and cost levels, which will make it very difficult for the Assessors/Valuation Office Agency to reflect the correct level of rateable value. This situation may allow us the opportunity to argue for lower levels of assessment in our appeal negotiations.

Anyone with an interest in a non-domestic property has an automatic right to appeal against the new assessment. In Scotland, appeals must be lodged within a limited period.

Feb/Mar 2010- In Scotland, Revaluation Notices Issued Advising New Rateable Value (appeals can now be lodged)
Feb/Mar 2010- Rates Bills Issued for 2010/11 based on New Assessments
1 April 2010- New Assessments come into force
30 September 2010- Revaluation Appeal Deadline for Scotland
