Commercial Energy Performance Certificate (EPC), Scotland, UK

As part of the EU EPBD part of the EU EPBD directive an Energy Performance Certificate or EPC will be required for commercial property for sale or rent in Scotland.

Publically owned commercial buildings over 1,000 sq m also NOW require an EPC.

Commercial Energy Assessment of property is wholly different from domestic property.

The assessor is required to obtain a large dataset of the commercial/industrial property to enter into Government approved software.

ALL "conditioned" commercial properties in Scotland over 50m² are legally required to have an EPC, when they are sold, let, substantially modified or constructed.

A "conditioned" building is one with a roof and walls which uses energy to condition the indoor climate i.e. some levels of heating, mechanical ventilation or cooling.

As such all Vendor’s and Lessor’s (incl) assignor’s would be advised to ensure that they have all of the information necessary to produce the EPC.

An EPC is a document which states the energy efficiency of a building based on the standardised way that the building is used. Carbon dioxide (CO2) ratings are shown in bandings from A to G, with A being the least polluting.

The main focus of the commercial energy performance certificate is the amount of CO2 which is estimated to be released from the building. The performance of the property is benchmarked against current building standards and recommended cost effective improvements.

The certificate must be fixed to the property and will be valid for a period of up to 10 years.

Working either directly with the Landlord, Tenant, or their solicitor or letting/selling agent we are able to provide a fully detailed and compliant Energy Report . Wilkinson and Co has successfully completed the necessary training and is fully accredited to use the SBEM software after completing the RICS Scotland Non Domestic Energy Assessment Training Programme as a fully certified Commercial Energy Assessor (CEA). Thus is able to produce the necessary EPC Certificate and report now required for class 3 & 4 existing and new build Properties.

Failure to provide an EPC for a commercial building can result in a fine of up to a maximum of £5,000. These laws are enforced by local Trading Standards departments.

So, the advice for owners and occupiers of buildings who have an obligation to produce an energy certificate is to ensure they collate as much information about their properties as possible.

First, this maximises the potential rating of the energy certificate and second, reduces the fees charged by the qualified Energy Assessor in collating this information from their surveys.
